HB 1310 - Under this act, a violation for failing to move over when the driver approaches a stationary emergency vehicle or for failing to pull over for an approaching emergency vehicle is classified as a Class A misdemeanor. The current law classifies the offense as a Class B misdemeanor. Under this act, a person commits the crime of involuntary manslaughter in the 1st degree if he or she fails to move over into another lane of traffic or slow down when he or she approaches a stationary emergency vehicle and with criminal negligence causes the death of an emergency worker. A violation in this nature is a Class B felony (Section 565.024).
Under this act, a person commits the crime of assault in the 2nd degree if he or she fails to move over into another lane of traffic or slow down when he or she approaches a stationary emergency vehicle and with criminal negligence causes injury to an emergency worker performing his or her official duties.
