SCS/HCS/HB 580 - This act creates the Line of Duty Compensation Act which provides additional workers’ compensation benefits in the amount of $25,000 for firefighters, law enforcement officers, air ambulance pilots, air ambulance registered professional nurses, and emergency medical technicians who are killed in the line of duty. Individuals are eligible for benefits when he or she dies as a result of an injury received in the active performance of his or her duties within the ordinary scope of his or her profession while on duty and but for the individual's performance, the death would not have occurred.
Subject to appropriation, a $25,000 death benefit shall be awarded to the surviving spouse, dependent, or estates of those killed in the line of duty.
Under the act, neither employers nor workers’ compensation insurers shall have subrogation rights against compensation awarded for claims under the proposed program.
This act contains an emergency clause.
This program shall sunset in 6 years unless reauthorized.
This act is similar to SB 500 (2007), HB 551 (2007), SB 966 (2008), and SB 332 (2009).
