HB 1073 Modifies provisions pertaining to agriculture

SS/SCS/HB 1073 & HCS/HB 1477 - The act modifies provisions pertaining to agriculture.

SECTION 142.031 - BIODIESEL INCENTIVE PAYMENTS

Under current law, a producer is eligible to receive payments from the Missouri Qualified Biodiesel Producer Incentive Fund for 60 months unless it fails to receive the full amount due to a lack of appropriations, in which case it is eligible for up to 24 additional months. This act removes the 24-month limitation and allows a producer's eligibility to receive payments to continue indefinitely until the full amount has been received.

This section is identical to HCS#2/HB 1462 (2012).

SECTION 178.530 - AGRICULTURAL EDUCATION IN PRIVATE SCHOOLS

The act requires the State Board of Education to establish standards for agricultural education that may be adopted by a private school. The standards must be sufficient to allow a private school to apply to host a local chapter of a national agricultural education association. These local chapters at private schools are not eligible to receive state or federal funding for agricultural vocational education and the private schools must annually reimburse the Department of Elementary and Secondary Education for its administrative costs.

This section is similar to HB 1953 (2012).

SECTIONS 256.400 TO 256.433 - SOUTHEAST MISSOURI REGIONAL WATER DISTRICT

The act prohibits large water consumers from taking and transporting water from within the Southeast Missouri Regional Water District to locations outside the district, if such taking and transporting interferes with the normal water usage of certain other large water consumers. If such interference occurs, the Attorney General or the affected parties may seek an injunction. No injunction may be issued if it would harm public health or safety.

This section is identical to SB 63 (2011) and similar to SB 604 (2010) and SB 556 (2009).

SECTION 262.795 - YOUTH WORKING ON FARMS

This act exempts farm work performed by children under the age of 16 from certain child labor requirements including: the obtaining of a work certificate; hours/days of performance; and certain prohibited hazardous jobs like operating and maintaining power-driven machinery, climbing ladders, operating vehicles, and working with certain chemicals. Kids may work on their own family farms and, when with the knowledge and consent of their parents, the family farms of others.

SECTIONS 270.270 AND 270.400 - EURASIAN SWINE (FERAL HOGS)

The act changes the reference from "European wild boar" to "Eurasian swine" in these statutes relating to feral hogs.

SECTION 276.401 - MISSOURI GRAIN DEALER LAW

Under current law, certain manufacturers and processors of animal feed are by definition not considered grain dealers under the Missouri Grain Dealer law if, among other things, such individuals do not purchase more than $100,000 worth of grain a year. This act replaces the $100,000 threshold with a 50,000 bushel threshold.

This section is identical to SCS/SB 631 (2012).

The act contains provisions similar to SCS/SB 491 (2012).

SA1: ADDS SECTION 350.015, WHICH CURRENTLY PROHIBITS ANY CORPORATION, WITH SOME EXCEPTIONS, FROM ENGAGING IN FARMING OR PURCHASING OR LEASING FARMLAND AFTER SEPTEMBER 28, 1975. A GRANDFATHER CLAUSE ALLOWED OPERATIONS IN EFFECT AS OF THAT DATE TO CONTINUE. THIS AMENDMENT CHANGES THE START DATE OF THE PROHIBITION TO SEPTEMBER 28, 2007 AND UPDATES THE GRANDFATHER CLAUSE TO MATCH THIS DATE.

SA4: ADDS SECTION 516.105, WHICH CURRENTLY PROVIDES A STATUTE OF LIMITATIONS TIME PERIOD OF TWO YEARS FOR MEDICAL MALPRACTICE ACTIONS AGAINST HEALTH CARE PROVIDERS. THIS AMENDMENT ADDS VETERINARIANS AND ENTITIES PROVIDING VETERINARIAN SERVICES TO THE LIST OF HEALTH CARE PROVIDERS. EXCEPTIONS TO THE TWO-YEAR TIME PERIOD PROVIDED TO MINORS UNDER CURRENT LAW DO NOT APPLY TO MINORS UNDER THE ACT WHO BRING SUITS AGAINST VETERINARIANS.

SA5: AMENDS SECTION 178.530 BY STATING THAT HOSTING A LOCAL CHAPTER OF A NATIONAL AGRICULTURAL EDUCATION ASSOCIATION DOES NOT CREATE NOR LIMIT THE ELIGIBILITY OF A PRIVATE SCHOOL TO RECEIVE STATE OR FEDERAL AGRICULTURAL VOCATIONAL EDUCATIONAL FUNDS FOR WHICH THEY WOULD OTHERWISE BE ELIGIBLE.
