HCS/SB 52 - This act changes provisions relating to the distribution of controlled substances in drug free zones.
Under this act, a person commits the crime of distribution of a controlled substance in a drug-free zone if he distributes, delivers, manufactures, or produces a controlled substance or possesses such a substance with the intent to distribute, deliver, manufacture or produce. This crime occurs in a drug free zone if such act occurs within:
1) One thousand feet of any private or public elementary or secondary school, public vocational school, or a public or private junior college, college or university, public housing or governmental assisted housing, public parks or recreation centers, day care facilities, youth centers video arcades or churches; or
2) Within one hundred feet of a school bus stop.
Distribution of a controlled substance in a drug free zone
is a Class B felony. Distribution of such substance in all other
instances is a Class C felony.
