SB 429 - This act makes it a crime to knowingly profit; use for profit, sell, purchase or transport for sale or profit any human remains of a Native American without the right of possession. A person who commits this crime is guilty of a Class C felony or a Class B felony for a second or subsequent violation. Native American is defined as an individual, tribe or people whose ancestors occupied this continent prior to European settlement.

This act also makes it a crime to knowingly profit, use for profit, sell, purchase or transport for sale or profit any Native American cultural items without the right to possession. A person who commits this crime is guilty of a Class D felony or a Class C felony for a second or subsequent violation. Cultural items are defined as including associated and unassociated funerary objects.
