SB 439 - This act states that on or after July 1, 1996 videos may not be sold or distributed in Missouri unless they are either open or closed-captioned for the hearing impaired.
Section 1 provides relevant definitions.
Sections 2 and 3 describe the videos that are being regulated by this act.
Section 4 provides for a phasing in of this law over one and one-half years beginning on January 1, 1996.
Section 6 provides for civil penalties of $5 per video, not to exceed $25,000 for the first violation and $100,000 for each subsequent violation. Section 6 also authorizes the Attorney General, prosecuting attorney, circuit attorney, or city attorney to bring an action to collect the penalties.
Section 7 details the injunctive relief that is available to plaintiffs, while Section 8 states that a defendant who has violated this act may be required to pay court costs and attorneys' fees. RONALD J. LEONE
