Children and Families are excluded from licensing by the
Department of Mental Health.

COMMITTEE ACTION:  Voted "do pass by consent" by the Committee
on Public Health by a vote of 12 to 0.

Under this bill, residential facilities and day programs
accredited by the Council on Accreditation are excluded from
licensing by the Department of Mental Health.

FISCAL NOTE:  No impact on state funds.

PROPONENTS:  Supporters say that adopting the standards of the
Council on Accreditation for residential facilities and day
programs would strengthen the standards for such facilities and
programs.  Supporters also state that adopting the standards of
the Council on Accreditation does not preclude the Department of
Mental Health from establishing a procedure for licensing
requirements pertaining to adequate facilities, general medical
and health care, and drugs and medication.  Further, the
Department of Mental Health is not precluded from conducting
inspections of residential facilities and day programs.

This bill revises provisions pertaining to licensing
requirements of the Department of Mental Health for reasonable
standards for residential facilities and day programs for
persons affected with a mental disorder, mental illness, mental
retardation, or developmental disability.

Residential facilities and day programs accredited by the
Council on Accreditation are excluded from licensing by the
Department of Mental Health.
