Current Bill Summary

SCS/SB 314 - This act requires a judge to issue a custody decision within 18 months of filing of the petition or motion, but in no event later than 60 days from the close of evidence in the case. In cases assigned to a commissioner, the case shall be submitted to a judge for review within 60 days after the close of evidence. Any judge or commissioner in violation shall report the case name and number to the circuit clerk, who shall post the notice and submit a copy to the Office of Administration. Any judge or clerk in violation shall not receive any increase in compensation or benefits for the following calendar year.

The act also requires circuit court clerks to file monthly updates to the Office of State Courts Administrator, tracking the date that any new petition to establish or motion to modify custody is filed and the date upon which the court issues a final decision in any such pending case.
