AN ACT
To amend chapter 196, RSMo, by adding thereto two new sections relating to the tobacco settlement fund commission, with an emergency clause.
Be it enacted by the General Assembly of the State of Missouri, as follows:
Section A. Chapter 196, RSMo, is amended by adding thereto two new sections, to be known as sections 196.1015 and 196.1018, to read as follows:
196.1015. 1. There is hereby established within the department of health the "Tobacco Settlement Fund Advisory Commission".
2. The commission shall be comprised of the following forty-one members:
(1) One member representing each of the state senatorial districts appointed by the governor with the advice and consent of the senate, who have expertise in prevention, treatment, research, community programs, mental health addictions, law enforcement, special populations, rural healthcare, urban healthcare and education. At least two such members shall be less than eighteen years of age, one of whom shall be a junior in high school or its equivalent, and one of whom shall be a senior in high school or its equivalent, and at least two such members shall be over the age of sixty-five;
(2) The directors of the departments of health, social services, and elementary and secondary education, who shall be nonvoting members; and
(3) One additional member from the city of St. Louis, one additional member from St. Louis County, and two additional members from Kansas City.
3. The duties of the commission shall include:
(1) To advise the governor and the general assembly regarding the development of strategies for best utilizing the tobacco settlement funds received by the state, for health care of Missouri citizens; and
(2) Preparation of a report pursuant to section 196.1018 regarding the conclusions of the commission.
4. The voting members of the commission shall elect one of their members to serve as chairperson of the commission. The voting members may elect such other officers as deemed necessary.
5. Members of the commission shall not be compensated for their services, but shall be reimbursed for actual and necessary expenses incurred during the performance of their duties.
6. The commission shall convene its first meeting on or before June 1, 2001.
7. The commission shall terminate on the date that its report is submitted to the governor, general assembly and departments of health, social services, and elementary and secondary education.
196.1018. The commission shall prepare a report evaluating suggested uses of tobacco settlement funds for health care purposes. The report shall be due no later than the thirty-first day of December, 2001. Copies of the report shall be submitted to the governor, general assembly and the departments of health, social services, and elementary and secondary education, in order to provide public guidance for any decisions appropriating tobacco settlement proceeds for health care.
Section B. Because of the need to determine funding priorities for the uses of the tobacco settlement proceeds, the enactment of sections 196.1015 and 196.1018 is deemed necessary for the immediate preservation of the public health, welfare, peace and safety, and is hereby declared to be an emergency act within the meaning of the constitution, and the enactment of sections 196.1015 and 196.1018 shall be in full force and effect upon their passage and approval.
