AN ACT

To amend chapter 307, RSMo, by adding thereto one new section relating to sound amplification systems in motor vehicles.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A.  Chapter 307, RSMo, is amended by adding thereto one new section, to be known as section 307.174, to read as follows:

307.174.  1.  No driver of a motor vehicle shall operate, or permit the operation of, any sound amplification system which can be heard outside the vehicle from one hundred or more feet when:

(1)  The vehicle is being operated upon a city street, highway or any right-of-way or parking area open to the

general public; or

(2)  The vehicle is parked upon any right-of-way or parking area open to the general public.  For the purposes of this subdivision, the owner or person in control of the vehicle shall be considered the driver of the vehicle.

2.  This section does not apply when a sound amplification system is being operated to request assistance or warn of a hazardous situation.  This section does not apply to authorized law enforcement vehicles, emergency vehicles or vehicles operated by gas, electric, communications, or water utilities.  This section does not apply to the sound systems of vehicles used for advertising, or in parades, political or other special events, except that the use of sound systems on those vehicles may be prohibited by a local authority by ordinance or resolution.

3.  This section shall have no application to private property which is not open to the general public.

4.  Any violation of this section shall be an infraction.
