AN ACT
To amend chapter 27, RSMo, by adding thereto one new section relating to the attorney general.
Section A. Chapter 27, RSMo, is amended by adding thereto one new section, to be known as section 27.063, to read as follows:
27.063. 1. Notwithstanding any other provision of law, any state executive branch, department, division, board, commission, council or authority that intends to enter into any contract or other written agreement or approve any letter of intent for payment of money by the state in excess of one hundred thousand dollars or potential reduction of a party's financial obligation to the state in excess of one hundred thousand dollars shall forward a copy to the attorney general before entering into that contract or other written agreement or approving that letter of intent. A contract, written agreement or letter of intent subject to this section includes, but is not limited to, any contract, written agreement or letter of intent related to:
(1) Tax credits pursuant to chapter 135, RSMo;
(2) Agreements entered pursuant to chapter 100, RSMo;
(3) An urban redevelopment corporation organized pursuant to chapter 353, RSMo;
(4) Any contract or written agreement pursuant to chapter 620, RSMo; or
(5) Any contract or written agreement pursuant to chapter 226, RSMo. 2. Upon receiving the contract or other written agreement, the attorney general shall, within ten days, review and approve or reject that contract for its legal form and content. If rejected, the attorney general shall provide a written basis for the rejection and the contract shall not be binding on the state. If the attorney general does not approve or reject the contract within ten days, the contract shall be deemed approved.
3. Communications related to the attorney general's review are attorney-client communications. The attorney general's written disposition shall be subject to chapter 610, RSMo.
