AN ACT
To amend chapter 168, RSMo, by adding thereto one new section relating to salary supplements for nationally-certified classroom instructional personnel.
Section A. Chapter 168, RSMo, is amended by adding thereto one new section, to be known as section 168.700, to read as follows:
168.700. 1. The state board of education shall establish a program of salary supplements for teachers in the public schools receiving certification from the National Board for Professional Teaching Standards. An annual salary supplement of five thousand dollars will be given to eligible persons for a period of ten years, commencing in the school year in which the teacher receives certification. To be eligible for such salary supplements, a teacher shall:
(1) Possess a valid Missouri certificate of license pursuant to this chapter;
(2) Possess a valid national teacher certification; and
(3) Be employed by a Missouri public school and be paid on a teaching salary schedule.
2. Any salary supplement received pursuant to this section shall be in addition to the base salary to which the teacher would otherwise be entitled. Teachers receiving the salary supplement shall receive any pay and benefits received by teachers of similar training, experience and duties.
3. Salary supplements authorized pursuant to this section shall be paid only during those school years in which the teacher is employed with a Missouri public school.
4. In addition to any payment received pursuant to this section, a teacher receiving certification from the National Board for Professional Teaching Standards may receive a payment equal to ten percent of the mentor teacher's base pay for any school year in which the teacher serves as a mentor teacher to other board certification candidates in a program established by a Missouri public school or school district and meeting standards established by the state board of education.
5. A school district that participates in the career ladder program pursuant to sections 168.500 to 168.515 may permit national board certified teachers who are receiving salary supplements pursuant to this section to be placed at the third stage of a career plan, pursuant to sections 168.500 to 168.515, based on the attainment of the national board certificate; however, such teachers shall supply a career plan and complete the duties specified therein. It is permissible for such teachers to select a portion of the work they performed for national board certification to be further developed as a part of their plan. Districts shall encourage career plans that involve using a national board certified teacher as a source of instructional knowledge and mentoring for other teachers.
6. For any school year in which a teacher achieves national certification as described in subsection 1 of this section, and subject to appropriation, the department of elementary and secondary education shall, pursuant to this section, supply the funds for the supplement for any teacher so certified. Any teacher seeking the supplement established pursuant to this section shall submit documentation of his or her national certification and documentation of his or her salary schedule placement to the department. The supplement paid pursuant to this section may be paid in a lump sum at the beginning of the fiscal year to a school district in the amount necessary to cover all of the salary supplements owed to teachers in the district, to be held by the district for a pro rata disbursement to be included in such teachers' paychecks or in such other manner as may be consistent with subsection 7 of this section.
7. The three teacher retirement systems created pursuant to chapter 169, RSMo, shall promulgate rules to address the inclusion of the salary supplements contemplated by this section, including the supplement for mentoring, as part of a teacher's compensation for the purpose of calculating benefits.
8. The department of elementary and secondary education shall promulgate rules for the implementation of this section. Any rule or portion of a rule, as that term is defined in section 536.010, RSMo, that is created under the authority delegated in this section shall become effective only if it complies with and is subject to all of the provisions of chapter 536, RSMo, and, if applicable, section 536.028, RSMo. This section and chapter 536, RSMo, are nonseverable and if any of the powers vested with the general assembly pursuant to chapter 536, RSMo, to review, to delay the effective date or to disapprove and annul a rule are subsequently held unconstitutional, then the grant of rulemaking authority and any rule proposed or adopted after August 28, 2002, shall be invalid and void.
