AN ACT

To amend chapter 208, RSMo, by adding thereto one new section relating to infant circumcision.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A. Chapter 208, RSMo, is amended by adding thereto one new section, to be known as section 208.661, to read as follows:

208.661. 1. Medicaid shall not reimburse any eligible provider for the performance of a non-therapeutic circumcision. For purposes of this subsection, the term "non-therapeutic circumcision" shall mean a routine or elective circumcision which does not meet the criteria of a medically necessary treatment.

2. For a circumcision to be eligible for Medicaid reimbursement, two physicians, licensed pursuant to chapter 334, RSMo, must examine the patient's foreskin and genital area and must document, in writing, that a disease, pathology, or other abnormality exists which requires a medically therapeutic circumcision which cannot be remedied using any less invasive measure.

3. A circumcision shall be eligible for Medicaid reimbursement if a provider licensed pursuant to chapter 334, RSMo, obtains and provides proof of a written notice from his or her patient or the patient's parent or legal guardian that a circumcision is required due to religious beliefs.

4. Any reimbursement claim submitted by an eligible provider for a therapeutic circumcision in the absence of the criteria set forth in subsections 1 and 2 of this section constitutes an act of unprofessional conduct by such provider. Any such claim shall render the provider and all other responsible parties civilly liable and professional disciplinary action may be taken by the provider's licensing board.
