AN ACT
To amend chapter 333, RSMo, by adding thereto one new section relating to liability of funeral directors and funeral establishments.
Section A. Chapter 333, RSMo, is amended by adding thereto one new section, to be known as section 333.271, to read as follows:
333.271. 1. For purposes of this section only, a person may designate a next of kin, regardless of blood or marital relationship, by means of a written instrument that is signed, dated and verified. Such designation may also be part of a duly executed will or trust.
2. No funeral director or funeral establishment licensed pursuant to this chapter shall be liable for actions taken regarding the funeral arrangements for a deceased person in their care if such actions are taken in reliance upon a person's claim to be the deceased person's next of kin, provided the director or establishment makes a good faith, reasonable effort to discover the validity of the claim.
