AN ACT
To amend chapter 71, RSMo, by adding thereto one new section relating to police officer residency requirements.
Section A.Chapter 71, RSMo, is amended by adding thereto one new section, to be known as section 71.203, to read as follows:
71.203.1.No city located not within a county or any home rule city with more than four hundred thousand inhabitants or board or commission located in any such city shall require any person applying for or holding a position of peace officer, as defined in subdivision (3) of section 590.010, RSMo, to reside within the limits of such city as a condition of employment.
2.No city located not within a county or any home rule city with more than four hundred thousand inhabitants or board or commission located in any such city shall discriminate in any manner against any person applying for or holding a position of peace officer because of such person's residency outside of the boundaries of such city except that such political subdivision may provide incentives, such as housing supplements or vehicle use guidelines, to encourage peace officers to locate within such political subdivision.
3.A city located not within a county or any home rule city with more than four hundred thousand inhabitants or board or commission located in any such city may require a peace officer to live within the state of Missouri.
4.The provisions of this section shall only apply to a city located not within a county or any home rule city with more than four hundred thousand inhabitants.
5.The provisions of this section shall not apply to use of department property as determined by any city located not within a county or any home rule city with more than four hundred thousand inhabitants or board or commission located in any such city.
