Current Bill Summary

SB 838 - This act provides that if a jury is unable to unanimously agree on the imposition of the death penalty, then the judge shall declare the punishment to be life imprisonment without eligibility for probation, parole or release except by act of the Governor. The jury shall be so instructed before the case is submitted.

The provisions of this act shall only govern offenses committed after August 28, 2004.

This act is identical to SB 256 (2003).
