SCS/SB 784 - Under this act, a person commits the crime of peace disturbance if he or she unreasonably or knowingly disturbs or alarms another person by harboring, keeping, or having under his or her control any dog upon his or her property that causes fear or annoyance to persons living in the immediate area or passing upon the streets or sidewalks near the property by frequently and habitually barking, yelping, or howling. This provision would not apply to a person who uses his or her property as a licensed kennel, veterinary clinic, or animal hospital. Peace disturbance is a Class B misdemeanor for the first offense and a Class A misdemeanor for the second or other subsequent offense.
