SCS/SB 530 - This act provides that the provisions allowing for a separate licensure category for facilities approved by the Department of Health and Senior Services for the Alzheimer's Demonstration Project shall expire on August 28, 2007. Demonstration projects authorized prior to the effective date of this act, whether or not constructed, shall continue to be exempt from the certificate of need law. However, such demonstration projects and the facilities they represent seeking to expand beyond the approved number of beds shall require certificate of need review with respect to the expansion. Demonstration projects authorized by the department, but which are neither constructed nor admitting residents as of August 28, 2007, shall not be exempt from certificate of need review, unless such projects formally declare in writing to the department, not later than December 1, 2007, their intention to commence construction and provide dementia-related care for Alzheimer's residents and actually commence providing dementia-related care in accordance with department standards prior to August 28, 2008.
