SB 545 - Current law provides that a product seller whose liability is based solely on his status as a seller may be dismissed from a products liability action, as long as the manufacturer is properly before the court and can cover the full cost of the plaintiff's judgment. This act provides that no claim of liability may be commenced or maintained against a product seller under any legal theory, unless the seller manufactured, produced, or designed the product, or unless the seller altered, modified, assembled, installed, or failed to maintain the product, in a manner that cause the claimant's harm.
The act also provides that a product seller otherwise immune from liability due to the aforementioned provision may still be sued for harm caused by a product if the manufacturer is not subject to personal jurisdiction in Missouri.
This act has an emergency clause.
This act is identical to SB 1112 (2006).
