Current Bill Summary

SS/SB 287 - This act provides that the "main" rather than "sole" purpose of the gaming commission fund is to fund administrative costs of the commission. The act also provides that comparison of revenues to expenditures and transfers for the preceding year shall be completed by the commission on or before October 1 of each year, and that on or before November 1 of each year the commission shall notify the office of administration (OA) of results of the comparison. The act authorizes OA to distribute the remaining net proceeds of the fund as specified in this act once it receives the above-mentioned comparison. The amount of annual matching grants to be made for veterans' service officer programs by the Missouri Veterans' Commission shall be raised from seven hundred fifty thousand to one million dollars. For fiscal year 1999 and after, 80 percent of the commissions total appropriations for administrative costs for the current fiscal year shall be distributed to the commission.

Current law provides that 4.5 million dollars shall be transferred to the Missouri college guarantee fund, with an additional .5 million being transferred after the remaining net proceeds in the gaming commission fund reach 28 million dollars; and that 3 million shall be transferred to the Missouri national guard trust fund with an additional 1 million to be transferred once the threshold is met; and that 3 million shall be transferred to the veterans' commission capital improvement trust fund with an additional 3 million to be transferred once the threshold is met. This substitute removes the 28 million dollar threshold, allowing for full transfer of the amounts to such funds.

The act also provides that up to 31 million dollars remaining in the fund, rather than 100 percent of the remaining net proceeds, after the above-mentioned appropriations shall be transferred to the Early Childhood Development, Education and Care Fund, and provides that if in the immediate previous fiscal year the state's net general revenue collections, less deposits made under this act, did not increase by 2 percent or more, the treasurer shall deposit moneys other than gifts, donations, or bequests received for the Early Childhood Development, Education and Care Fund shall be deposited into the state general revenue fund.

The act also allows the commission to receive the remaining 20 percent of its appropriation for administrative costs once the above-mentioned transfers have been made, and requires that all moneys remaining in the Gaming Commission Fund after all distributions and transfer have been made be transferred to the Veterans' Commission Capital Improvement Trust Fund.

Provisions in this act are identical to HB 1845 (2006), and similar to HB 179 (2007).
