The definition of "construction" only includes new construction, enlargement, or major alteration. Reconstruction, improvement, painting and decorating, and major repair are no longer considered construction for the purposes of prevailing wage.

The definition of "maintenance" only includes the repair or restoration of the material condition or operation, or the painting or repainting of existing facilities when the size, typ or extent or the existing facilities is not thereby changed or increased. Replacement of existing facilities is no longer considered maintenance for the purposes of prevailing wage.

"Major alteration" is defined as an alteration or structural change to and existing facility which increases the size, type, or extent of the facility.

The Missouri Supreme Court's holding of Utility Service Co., v. the Department of Labor and Industrial Relations, and the Labor and Industrial Relations Commission of Missouri is abrogated.

This act is similar to SB 176 (2011).
