HB 1972 -- Sewer Service Line Fees

This bill requires the county office that administers the lateral sewer service line repair fee program to bill each condominium unit separately for its proportionate share of the fee. An individual condominium unit owner cannot be jointly and severally liable for any assessed fee. A condominium association may elect to have the total assessed fees billed to it and paid from condominium association dues or other funds. This billing procedure is mandatory and if a county fails to comply, any fees assessed during the period of noncompliance will be deemed waived.
If a county office is found by a court of competent jurisdiction to have violated these billing procedures by collecting moneys from an individual owner that are not owed to the billing municipality or to the county office, the county office will be liable for all attorney fees and costs and may be ordered to pay a penalty of not less than $2,500 to the owner.
