SB 85 - This act authorizes the city of Arnold to create a utility board or a public nonprofit utility corporation. A utility board or corporation may review and establish rates for sanitary sewer, storm water, trash, or any other utility service authorized by the city council. A utility corporation may assume the management, operation, maintenance, or other provisions of utility service that the city council has given the corporation. A utility board or the board of a utility corporation shall have between five and seven members that will be appointed by the mayor with the consent of the city council. The terms of the members will be five years except that the first five members will have staggered term lengths. Persons must be registered Missouri voters and residents of the city to be appointed. The mayor, one member of the city council, and designated city staff will be nonvoting members of the board.
Rates and fees existing at the creation of a utility board or corporation will remain in effect until they are changed by the board or corporation. Rates and fees cannot be changed unless a public hearing with proper notice has been held.
Utility corporations may be required to reimburse the city for services provided to the corporation by the city. Utility corporations may hire staff, buy equipment, and contract for services or contract with the city to provide such services.
