HCS/SB 294 - This act modifies provisions relating to public utilities.PUBLIC SERVICE COMMISSION INTERVENTION IN LEGAL PROCEEDINGS (Section 386.210) - Currently, the Public Service Commission does not have the authority to intervene in certain legal proceedings allowable by federal administrative rules. This act would allow the Public Service Commission to intervene in certain legal proceedings where the Commission has standing.
This section is similar to the perfected HB 432 (2013).
ASSESSMENT OF WATER AND SEWER UTILITIES (Section 386.370) - Currently, water and sewer corporations are treated separately for the purpose of determining the Public Service Commission assessment. This act will combine all water and sewer corporations into one group of public utilities for assessment purposes.
This section is identical to SB 335 (2013), SS/SCS/HB 142 (2013), and HB 789 (2013).
STOCK OWNERSHIP SALE OF SMALL UTILITIES (Section 393.190) - This act requires that any person, corporation, or utility who wishes to acquire fifty percent or more of the total stock issued by the water or sewer corporation must get permission from the Public Service Commission. No small water or sewer corporation that is delinquent in filing an annual report with the Public Service Commission, is delinquent in paying an assessment to the Public Service Commission, or is in violation of Public Service Commission or Missouri Department of Natural Resources rules or regulations shall be able to sell or transfer fifty percent or more of its total capital stock issued without consent from the Commission.
This section is similar to SB 334 (2013), SS/SCS/HB 142 (2013), and HB 788 (2013).
JOINT MUNICIPAL UTILITY COMMISSION ACT (Section 393.760) - This act removes the public voting procedure for municipal bonds indebt the joint municipal utility commission and instead only requires the governing bodies of each contracting municipality to vote for such bonds. This vote must be approved by 3/4 of all governing bodies of the contracting municipalities.
This section is identical to a section contained in SCS/SB 297 (2013) and SS/SCS/HB 142 (2013).
RATEMAKING FOR WATER UTILITIES (Section 393.1000-393.1003) - Currently, only water corporations in St. Louis County may utilize infrastructure system replacement surcharges (ISRS). This act makes all water corporations eligible provided the corporations produce ISRS revenues of at least one million dollars, but not more than 10% of the water corporation's base revenue. This act modifies the types of projects that qualify as water utility plant projects. The provisions of this section shall expire for all water corporations except for those located in St. Louis County on August 28, 2019, unless reauthorized by the General Assembly.
