HB 326 - Under current law, second degree sexual misconduct is a Class B misdemeanor unless the actor is a prior offender, in which case it is a Class A misdemeanor.

This act makes the crime a Class D felony if the actor was incarcerated in a Department of Corrections facility at the time of the crime.

This act is identical to SB 243 (2013).
