HCS/HB 28 - This act allows political subdivisions to adopt orders or resolutions with penalties that relate to natural disasters of major proportions within the county when the safety and welfare of the inhabitants are jeopardized. Such orders and resolutions may include burn ban orders, that carry a penalty of a Class A misdemeanor, during times of drought. This act also specifies that violations of such orders or resolutions shall be infractions.

State agencies responsible for fire management or suppression and anyone conducting agricultural burning using best management practices are not subject to the orders or resolutions. In addition, the burn ban order shall not affect the ability to sell fireworks.

This act also allows county commissions to promulgate reasonable regulations concerning emergency management functions, operations, and conditions controls that relate to natural disasters in the county when the health, safety, or welfare of the inhabitants are threatened. The regulations may include burn ban orders carrying a penalty of up to a Class A misdemeanor in times of drought.

Current law allows county commissions in first, second, or fourth class counties to promulgate reasonable regulations concerning the use of county property, and violations of such regulations are punishable as infractions. This act provides that the regulations may carry a penalty of up to a Class A misdemeanor.
