Current Bill Summary

SB 358 - This act exempts industrial hemp, which is defined as cannabis sativa L. containing no greater than one percent THC, from the definition of marijuana and the list of controlled substances.

In addition, this act specifies that it is legal for any person who has not been convicted of any drug-related offense to grow and cultivate industrial hemp.

Under this act, the burden of proof is on the defendant to prove that a substance is industrial hemp and not a controlled substance.

This act is identical to HB 620 (2011).
