SCS/SB 365 - This act modifies the definition of franchise under Missouri franchise law, specifically for agreements between alcohol wholesalers and suppliers so that a franchise may exist even without a license to use a trade name, trademark, or service mark and regardless if there is a community of interest in the marketing of the products. This act provides an exemption for wine suppliers selling 10,000 cases annually or less. Further, this act states that it is the General Assembly's intention for the judicial interpretation of cases involving the definition of franchise to rely on certain state cases as indicated as opposed to a recent federal court decision as specified. This act is similar to SCS/SB 837 (2012) and HCS/HB 1841 (2012).
