HCS/HB 1058 - This act establishes the Alcohol and Tobacco Control Trust Fund. Money collected under the liquor control chapter, except charges for the privilege of selling spiritous liquors or wines, and fines collected for selling tobacco products to minors are to be deposited by the State Treasurer into the trust fund. Money in the fund must be appropriated by the General Assembly to support the Division of Alcohol and Tobacco Control in the regulation of liquor and tobacco.
Under current law, all fees collected by the Department of Revenue under the liquor control chapter, including license, inspection, and gauging fees are to be paid into the general revenue fund. This act specifies that all license fees and charges for the privilege of selling spiritous liquors and wines and the inspection and gauging fees on malt liquor collected by the Division of Alcohol and Tobacco Control are to be paid into the general revenue. All other fees collected by the Division of Alcohol and Tobacco Control must be paid into the Alcohol and Tobacco Control Trust Fund.
