SCS/SB 843 - This act requires an enrollee in a health maintenance organization (HMO) or a health insurance plan to pay only the usual and customary retail price of a prescription drug if the co-payment applied by an HMO or health insurer exceeds the usual and customary retail price, provided such prescription has not been adjudicated through the HMO, and there shall be no further charge to the enrollee or plan sponsor for the prescription. This act is identical to a provision in SS/SCS/SBs 865 & 866 (2016), substantially similar to another provision in SS/SCS/SBs 865 & 866 (2016), and similar to SB 674 (2012).
