HCS/SB 864 - The act provides that only a licensed pharmacist can make the determination to dispense an emergency supply of medication without the authorization from the prescriber.

This provision is identical to provisions contained in CCS #2/HCS/SS/SB 608 (2016), CCS/HCS/SB 635 (2016), and in the perfected version of SB 457 (2015).

A pharmacist may dispense varying quantities of maintenance medication per fill up to the total number of dosage units as authorized by the prescriber, unless the prescriber has specified that dispensing a prescription for maintenance medication in an initial amount is medically necessary. When the dispensing of the maintenance medication is based on refills then the pharmacist shall dispense no more than a 90 day supply and the patient must have already been prescribed the medication for 3 months.

This provision is identical to provisions in CCS/HCS/SS/SCS/SBs 865 & 866 , CCS/HCS/SCS/SB 973 (2016), CCS #2/HCS/SS/SB 608 (2016), HCS/SB 831 (2016), SS/SCS/HB 1816 (2016), and similar to SCS/HB 1682 (2016) and HB 2406 (2016).

HA 1 - PROHIBITS A HEALTH CARRIER OR OTHER INSURER THAT WRITES VISION INSURANCE FROM REQUIRING AN OPTOMETRIST TO PROVIDE SERVICES OR MATERIALS AT A DISCOUNT THAT ARE NOT COVERED AND REIMBURSED UNDER THE PLAN.

HA 2 - REQUIRES THE DEPARTMENT OF HEALTH AND SENIOR SERVICES TO ESTABLISH CRITERIA FOR LEVELS OF MATERNAL CARE DESIGNATIONS AND LEVELS OF NEONATAL CARE DESIGNATIONS FOR BIRTHING FACILITIES.

HA 3 - MODIFIES THE AMOUNT THAT HEALTH CARE PROVIDERS MAY CHARGE A PATIENT FOR THE SEARCH AND RETRIEVAL OF HIS OR HER MEDICAL RECORDS AND ALLOWS A PROVIDER TO DISCLOSE A DECEASED PATIENT'S HEALTH CARE RECORDS TO THE EXECUTOR OR ADMINISTRATOR OF THE PATIENT'S ESTATE.

HA 4 - ESTABLISHES THE DESIGNATED HEALTH CARE DECISION-MAKER ACT.

HA 5 - ALLOWS A PHARMACIST TO PRESCRIBE AND DISPENSE SELF-ADMINISTERED ORAL HORMONAL CONTRACEPTIVES AND REQUIRES HEALTH CARRIERS AND HEALTH BENEFIT PLANS TO PROVIDE COVERAGE TO REIMBURSE A PROVIDER OR DISPENSING ENTITY FOR THE DISPENSING OF A 90 DAY SUPPLY OF PRESCRIPTION CONTRACEPTIVES.

HA 6 - REQUIRES THE DEPARTMENT OF HEALTH AND SENIOR SERVICES TO PROMULGATE REGULATIONS FOR THE CONSTRUCTION AND RENOVATION OF HOSPITALS THAT INCLUDE LIFE SAFETY CODE STANDARDS REFLECTIVE OF THE STANDARDS IMPOSED BY MEDICARE.

HA 7 - REQUIRES THE AMBULANCE DISTRICT BOARD OR THE FIRE PROTECTION DISTRICT BOARD IN FOURTH CLASS COUNTIES TO SET THE REIMBURSEMENT RATE RECEIVED FROM THE SPECIAL ALLOCATION FUND.

Amendments
