SCS/HCS/HB 2561 - This act modifies provisions relating to victims of crime. ADDRESS CONFIDENTIALITY PROGRAM - 589.660 & 589.663
Under current law, the Secretary of State administers a program to protect victims of domestic violence, rape, sexual assault, or stalking by assigning substitute addresses to such victims. State and local government agencies must accept the substitute address when creating public records relating to a participant in the program.
This act provides that victims of human trafficking may also participate in the program.
This provision is identical to SB 888 (2016), HB 1396 (2016), the truly agreed to and finally passed HCS/HB 1562 (2016), and SB 211 (2015).
COMPENSATION TO MENTAL HEALTH PROVIDERS - 595.030
Under current law, compensation paid for mental health services from the Crime Victims' Compensation Fund may only be paid if the service provider is a certain licensed professional. This act adds licensed board-certified psychiatric-mental health clinical nurse specialists and nurse practitioners to the list.
This provision is substantially similar to a provision in the truly agreed to and finally passed CCS/SCS/SB 921 (2016) and is identical to HB 1403 (2016).
HUMAN TRAFFICKING INFORMATIONAL POSTERS - 595.120
This act requires the Department of Public Safety to create a poster by January 1, 2017, that provides information regarding the national human trafficking resource center hotline. This act specifies the size of the poster and certain information that must be included.
Beginning March 1, 2017, the poster must be displayed in a conspicuous place in or near the bathrooms or near the entrance of certain types of establishments specified in the act.
The department must make the poster available for print on its public website.
Any owner or operator of an establishment required to post the human trafficking hotline notice who fails to comply with the requirement is subject to a written warning for the first violation and may be guilty of an infraction for any further violations.
RIGHTS FOR VICTIMS OF DOMESTIC ASSAULT - 595.209
Under current law, victims of certain specified crimes automatically have certain enumerated rights. Victims of other types of crimes have the same rights upon written request. This act adds victims of domestic assault to the list of crime victims who automatically have the enumerated rights.
This provision is similar to a provision in the truly agreed to and finally passed CCS/SCS/SB 921 (2016), HB 2133 (2016), and HCS/SS/SCS/SB 663 (2016).
