SB 198 - This act establishes a regulatory scheme for weigh station and inspection site bypass services. Bypass services are under the exclusive authority of the Missouri State Highway Patrol (MSHP), except that the Department of Transportation may approve construction designs for weigh-in-motion systems on public roads. This act provides that if possible, MSHP shall contract with multiple private entities to provide bypass services. Bypass service providers shall provide real-time data access to their weigh-in-motion systems and associated data to the state and to other bypass service providers.
MSHP, when in the best interest of the state, shall require bypass service providers to share systems and associated data. This act provides for use-based cost sharing, should this requirement be applied to a pre-existing weigh-in-motion system.
MSHP shall not arbitrarily impose a maximum number of bypass sites which may be established, and shall apply consistent rules and rates across all bypass services.
This act provides that no state employee, representative, or designee shall be an officer or director of, or owe any duty to, an entity that provides weigh-in-motion services within the state.
This act provides a procedure for applying to establish or operate a bypass service site, and a sixty-day time limit for approval or denial.
This act provides that MSHP may set criteria for installation of technology into the roadway, so long as they do not exceed ASTM 1 standards. MSHP shall require all bypass service providers to adjust weight readings upward to account for the systems' tested margin of error.
This act is similar to HCS/HB 306 (2017).
