SB 352 - Under current law, there is a 10-year statute of limitations on an action for damages for personal injury caused by incest. This act provides that such actions may be commenced at any time. Current law also provides that an action to recover damages from injury caused by childhood sexual abuse may be commenced within 10 years of the plaintiff turning 21 or within 3 years of the date the plaintiff discovers the injury. This act provides that such actions may be commenced at any time.
Under current law, certain acts of child abuse may not be prosecuted after three years have elapsed. This act provides that there is no statute of limitations for child abuse prosecutions.
In addition, current law provides that prosecutions for certain unlawful sexual offenses involving a person 18 years of age or younger must be commenced within 30 years of the victim turning 18. This act provides that such prosecutions may be commenced at any time.
This act is similar to HB 519 (2017), HB 1120 (2017), provisions of HCB 9 (2017), and HB 167 (2015) and is identical to SB 696 (2016) and SB 467 (2015).
