SJR 39 - Upon voter approval, this resolution modifies Constitutional provisions relating to reapportionment of the General Assembly.

Currently, the reapportionment commission shall reapportion the House of Representatives by dividing the population of the state by 163, and shall reapportion Senatorial districts by dividing the population of the state by 34. This resolution requires that the commission divide the population of United States citizens by 163 or 34, respectively, with such figures being called the "house district mean" and "senate district mean".

Currently, each House of Representatives district shall be composed of contiguous territory, as compact as may be. This resolution prohibits the requirement that such district be composed of contiguous territory from being violated. Further, each district shall be compact as may be after accounting for county and city lines and geographic boundaries. Similarly, this resolution also prohibits the requirement that Senatorial districts be composed of contiguous territory from being violated.

This resolution requires that only citizens of the United States be counted as part of the population when making apportionments of the House of Representatives and Senate.

This resolution is similar to SJR 37 (2018), HJR 99 (2018), and HJR 100 (2018).
