SCS/SB 287 - This act enacts provisions relating to health insurance.PREGNANCY AS A QUALIFYING LIFE EVENT FOR A SPECIAL ENROLLMENT PERIOD (Section 376.1212)
This act provides that any health benefit plan delivered, issued for delivery, continued, or renewed on or after January 1, 2020, in which a person may only enroll during an initial, open, or special enrollment period shall permit enrollment of a pregnant person at any time after the commencement of her pregnancy.
The health benefit plan may require that the pregnancy be certified by a health care practitioner who is licensed in the state and acting within the scope of his or her practice. Coverage shall be effective as of the first day of the month the pregnancy was certified, or if no certification is required, as of the first day of the month the self-attestation of the pregnancy was made by the pregnant person.
These provisions are identical to provisions in the perfected SS/SCS/SBs 70 & 128 (2019), and substantially similar to SB 879 (2018), SB 274 (2017), and SB 1142 (2016).
OFF-LABEL USE OF DRUGS FOR CANCER TREATMENT (Section 376.1260)
This act specifies that each health benefit plan delivered, issued for delivery, or renewed in the state shall provide coverage for off-label usage, as defined in the act, of drugs for purposes of cancer treatment. Coverage shall be provided when at least two licensed physicians prescribe or recommend the drug and attest it may extend the enrollee's life.
These provisions contain an emergency clause.
These provisions are similar to provisions in the perfected SS/SCS/SBs 70 & 128 (2019).
