SB 306 - This act modifies several provisions relating military affairs.

RIGHTS OF MEMBERS OF THE MISSOURI NATIONAL GUARD AND ACTIVE GUARD RESERVES

This act extends the provisions of the federal Servicemembers Civil Relief Act (SCRA) and Uniformed Services Employment and Reemployment Rights Act (USERRA) to all members of the Missouri Active Guard Reserves with 30 or more consecutive days of service and to all members of the Missouri National Guard who are called to active duty by an executive order from the Governor.

The Department of Labor and Industrial Relations is required to make available a notice covering certain employment rights, reemployment rights, and civil relief rights that apply to members of the Missouri National Guard along with contact information to the Missouri Veterans Commission. Every employer is required to post the notice in each employment establishment.

Any member of the Missouri Active Guard Reserves or the Missouri National Guard who believes his or her rights were violated may bring suit. The Office of the Attorney General may also bring suit against an employer for violations of this act.

This act provides active and reserve members of the United States Armed Forces and the Missouri National Guard the right to cancel contracts for telecommunications services, internet services, satellite or streaming television services, athletic club or gym memberships, satellite radio service, or other similar services without penalty if ordered to a duty location that does not support the contract for more than 30 days. Termination of these contracts must be made by delivery of a written or electronic notice of termination and a copy of military orders to the service provider.

These provisions are identical to HB 366 (2019).

SCHOOL REGISTRATION FOR CHILDREN OF MILITARY MEMBERS

This act allows remote registration of a student if one or both of the child's parents are being relocated to Missouri under military orders. Proof of residency shall not be required at the time of registration, but shall be required within 10 days of the student's attendance.

This provision is identical to HB 365 (2019).

IN-STATE TUITION FOR DEPENDENTS OF MILITARY MEMBERS

This act establishes that the determination of eligibility for in-state tuition rates at public institutions of higher education for dependents of military members stationed in Missouri shall be made at the time the dependent is accepted for admission.

This provision is identical to HB 367 (2019).
