Current Bill Summary

SB 975 - Under current law, the board of trustees of any reorganized common sewer district may petition a circuit court for an amended decree of incorporation to allow the district to operate water supply and distribution facilities that serve 10 or more separate properties in the district and that are not served by another political subdivision or located within the certificated area of a water corporation. This act now states that a sewer district may petition a circuit court to operate water supply and distribution facilities in an area not served by another political subdivision within the certificated area of a water corporation.

This act allows the board of trustees of a reorganized common sewer district and the board of directors of a public water supply district to jointly petition a circuit court to amend the decrees of incorporation to allow the districts to consolidate the water supply district into the reorganized common sewer district.

Further, under the act, the governing body of certain sewer districts may provide service within a sanitary sewer improvement area.

The act states that a sewer district may, rather than shall, make assessments and may impose user fees on the property located within the sanitary sewer improvement area to pay for any, all, or part of the cost of such improvements and service, including but not limited to the cost paid by it as principal and interest of any temporary notes and revenue bonds.

Finally, The act repeals a provision requiring the sewer district to use moneys collected from assessments and user fees from a sanitary sewer improvement area to reimburse the district for all amounts paid or to be paid by it as principal of and interest on its temporary notes and revenue bonds issued for the improvements made in the sanitary sewer improvement area.

This act is similar to HB 2322 (2020).
