SB 1028 - This act modifies provisions relating to community service requirements for DWI offenders.

DRIVING WHILE INTOXICATED (Section 577.010)

Under current law, a person found guilty of the offense of driving while intoxicated who is a prior offender shall not be granted parole or probation until he or she has served a minimum of ten days in prison unless, as a condition of such parole or probation, the person performs at least thirty days of community service.

This act modifies this provision to include that a person will perform at least thirty days "involving at least two hundred forty hours" of community service.

DRIVING WITH EXCESSIVE BLOOD ALCOHOL CONTENT (Section 577.012)

Under current law, a person found guilty of the offense of driving with excessive blood alcohol content who is a persistent offender shall not be granted parole or probation until he or she has served a minimum of thirty days in prison unless, as a condition of such parole or probation, the person performs at least sixty days.

This act modifies this provision to include that a person will perform at least sixty days "involving at least four hundred eighty hours" off community service.
