HB 1296 - This act modifies the offense of possession of unlawful items in a prison or jail to include if such person knowingly delivers, attempts to deliver, possesses, deposits, or conceals in or about the premises of any correctional center any two-way telecommunications device or the component parts. Such a violation shall be a Class E felony. This act shall not apply to any law enforcement officer lawfully engaged in his or her duties, any person authorized by a correctional center or jail to possess or use a two-way telecommunications device, or any person who is not an inmate possessing a two-way telecommunications device or component parts without the intent to conceal or deliver to another person, unless such person refuses to surrender such device, in which case he or she shall be guilty of a Class A misdemeanor.
