Current Bill Summary

SB 1010 - Under this act, emergency medical services personnel shall comply with an outside the hospital do-not-resuscitate order from another state, the District of Columbia, or a U.S. territory if such order is on a standardized form, signed by the patient or the patient's representative and a licensed physician, and such form has been previously reviewed and approved by the Department of Health and Senior Services. Emergency medical services personnel shall not comply with the order if the patient or the patient's representative expresses to such personnel the desire to be resuscitated. Physicians, emergency medical service personnel, and health care facilities shall not be subject to civil, criminal, or administrative liability for complying with an outside the hospital do-not-resuscitate order from another state, the District of Columbia, or a U.S. territory.

This act is identical to provisions in the truly agreed to and finally passed SS/SCS/HCS/HB 1682 (2020) and substantially similar to provisions in HCS/SS/SB 580 (2020).
