SB 1017 - This act prohibits, beginning August 28, 2021, any person or entity from manufacturing, processing, selling, or distributing asbestos or any mixture or article containing asbestos. Exemptions are granted to the end-use of a mixture or article containing asbestos and installed in a building or other structure before August 28, 2020, as well as to the distribution of a mixture or article containing asbestos solely for the purpose of disposal of the mixture or article in compliance with applicable federal, state, and local requirements. The Labor and Industrial Relations Commission (LIRC) is permitted to grant exemptions from this prohibition for a period of up to three years if it is necessary to protect law enforcement interests or the security interests of the state or any political subdivision and no feasible alternative to the manufacture, processing, or distribution in commerce of asbestos or any mixture or article containing asbestos exists for the intended use. Such an exemption may be extended once for a period of three years. All applications for exemptions shall be filed with the LIRC, which shall be subsequently published in the Missouri Register. Any exemptions granted shall additionally be published in the Missouri Register.
Persons or entities granted an exemption from the prohibition shall file a report with the LIRC within 6 months of receiving the exemption and once every 6 months thereafter.
The LIRC is required to submit a report to the General Assembly detailing certain information regarding the presence of asbestos in residential, commercial, industrial, public, and school buildings and the extent of exposure and risk to human health associated with the asbestos present in those buildings from all commercial, industrial, and consumer activities that may result in asbestos exposure.
