SB 32 - This act specifies that no commercial motor vehicle shall operate in this state unless operated or occupied by a natural person holding the appropriate commercial driver's license (CDL). The owner of a commercial motor vehicle operated in violation of this requirement shall be guilty of a Class A misdemeanor. An owner who provides proof to the court that a natural person holding a CDL was present in the vehicle at the time the citation was issued shall not be guilty of this offense.
No court shall suspend the imposition of sentence or issue a fine in lieu of a term of imprisonment, nor shall the owner be eligible for probation or parole until he or she has served a minimum of 48 consecutive hours of imprisonment, unless as a condition of such parole or probation the owner performs at least 10 days involving at least 40 hours of community service under the supervision of the court in those jurisdictions which have a recognized program for community service.
