SB 458 - This act establishes the "Missouri Unborn Child Protection from Dismemberment Abortion Act". It shall be unlawful for any physician to purposely perform or attempt to perform a dismemberment abortion and thereby kill an unborn child, except in cases of medical emergency. A person found to have violated this act shall be guilty of a Class E felony and subject to professional license suspension or revocation. A physician accused of violating this provision may seek a hearing before the State Board of Registration for the Healing Arts on whether the procedure was necessary in cases of a medical emergency and the Board's finding shall be admissible on that issue in any trial. Additionally, this act provides for injunctive relief against a physician found to have violated this act. Finally, this act provides that the identity of the woman upon whom the abortion was performed or attempted to be performed shall not be subject to public disclosure in certain circumstances.SARAH HASKINS
