SB 614 - This act provides that all electronic monitoring service providers and their subcontractors used for court ordered electronic monitoring for certain offenders under an order of protection shall be approved by the Office of State Courts Administrator and shall meet certain requirements as provided in the act. All electronic monitoring service providers and their subcontractors shall provide GPS electronic monitoring services that dispatch emergency services after an exclusion zone alert is active for more than three minutes; dispatch emergency services immediately after a device tamper alert becomes active; receive exclusion and inclusion zones from the court prior to the installation of the service; and have certain other capabilities as provided in the act.
This act also provides that all electronic monitoring service providers and their subcontractors shall provide alcohol electronic monitoring services that determine the presence of alcohol and if the presence of alcohol is due to an environmental exposure or consumption of alcohol. Additionally, the monitoring device shall be constructed of material that will indicate a tampering of the device.
All electronic monitoring service providers shall submit a written violation report to the court and the prosecuting or circuit attorney's office within 12 hours of the violation or at the opening of the next business day. All violation reports must include certain information as provided in the act.
Finally, the Office of State Courts Administrator shall maintain a list of all qualified electronic monitoring service providers and make such list available to all Missouri courts and prosecuting or circuit attorneys.
