SB 1054 - This act provides that a charge of up to $50 may be received by a sheriff for service of any summons, writ, or order for an eviction proceeding. All charges shall be collected by the sheriff prior to the service being rendered and paid to the county treasury. The county treasurer shall make such moneys payable to the state treasurer who shall deposit such moneys into the Sheriffs' Retirement Treasury Fund, as created in this act for the disbursement to the Sheriff's Retirement Fund for the sole use by the Sheriffs' Retirement System. Currently, neither the General Assembly nor the governing body of a county is allowed to appropriate funds for deposit in the Sheriffs' Retirement Fund. This act allows appropriations for moneys collected for service received by county sheriffs that have been disbursed by the state treasurer to the Sheriffs' Retirement Fund. Finally, this act repeals the current $3 court filing surcharge that funded the Sheriffs' Retirement Fund along with the requirements for county or City of St. Louis participation in the funding mechanism and for a summary of all surcharges collected for the Sheriffs' Retirement Fund prepared by the circuit clerk.
This act is substantially similar to HB 2681 (2022).
