SB 648 - Under the act, in any licensing agreement related to pole attachments, as defined in the act, a party's covenant, promise, or agreement to indemnify or hold harmless another person for the person's own negligence or wrongdoing is void as against public policy and unenforceable. Any such agreement, covenant, or promise to grant a rural electric cooperative a security interest in any portion of a cable operator's, video service provider’s, or a broadband provider's communications network or facilities is void as against public policy and unenforceable.
This act only applies to areas receiving state or federal broadband awards. An electric cooperative shall not unreasonably delay implementing agreements under the act.
This act will only apply to contracts or agreements entered into after August 28, 2023. This act contains an emergency clause.
