SB 125 - Under current law, if the Parole Board finds an offender violated conditions of his or her parole, the board may revoke such parole. This act adds that there shall be a presumption against revoking parole and ordering a term of incarceration for a technical violation of parole unless the violation demonstrates an imminent threat to public safety. A technical violation shall be a violation of the specific terms and conditions of parole other than by a conviction of a new offense.
Finally, this act provides that a court shall reduce jail time by all or part of the time the defendant served on probation.
