The following is a summary of the House Committee Substitute for HB 100.

Currently, any person or entity that is engaged in the act of contracting with providers for the delivery of dental services or the selling or assigning of dental network plans to other health care entities cannot sell, assign, or otherwise grant access to the dental services of a participating provider under a health care contract unless expressly authorized by the health care contract.

This bill modifies the statute to say any person or entity including a health carrier that is engaged in the act of contracting with providers for the delivery of health care services shall not sell, assign, or otherwise grant a network plan access to a participating provider's health care services until the contracting entity has notified the participating provider 30 days in advance of such participating provider's health care services being made available to the network plan's participants and the participating provider has agreed in writing separate from any other agreement entered into before the receipt of the notification. The notification must identify the network plan, the health care services included, and a fee schedule, if different from the network plan for which the participating provider is currently providing health care services.

Health carrier is defined in the bill as an entity subject to the insurance laws and regulations of this state that contracts or offers to contract to provide, deliver, arrange for, pay for or reimburse any of the costs of health care services, including a sickness and accident insurance company, a health maintenance organization, a nonprofit hospital and health service corporation, or any other entity providing a plan of health insurance, health benefits, or health services; except that such plan shall not include any coverage pursuant to a liability insurance policy, Workers' Compensation insurance policy, or medical payments insurance issued as a supplement to a liability policy.

Additionally, a health carrier shall include any contractual arrangement to provide, either directly or through arrangement with others, specified dental benefits to enrollees on a fixed prepayment basis or as a benefit of such enrollees' participation or membership in any other contract, agreement, or group or any corporation, partnership, or other entity which undertakes to provide or arrange specified dental benefits on a prepayment or other basis or to indemnify for specified dental benefits

PROPONENTS: Supporters say that this will require companies to coordinate further with health care plan providers to ensure that they are aware of the plans that are being sold and used on their behalf. This would increase fairness and transparency, avoid awkward payment processing encounters, and may increase collection ability.

Testifying in person for the bill were Representative Davidson; Association of Dental Support Organizations; and Mo Dental Association.

OPPONENTS: Those who oppose the bill say that this is an issue between networks and leasing and does not require legislative intervention.
