HCS/HB 183 - This act prohibits a school district, charter school, or public or private institution of postsecondary education from allowing any student to compete in an athletic competition that is designated for the biological sex opposite to the student's biological sex as stated on the student's official birth certificate. The act delineates what constitutes an acceptable official birth certificate.

The act prohibits public schools from being members of any statewide athletic organization that permits a student to compete in an athletic competition designated for the biological sex opposite to the student's biological sex.

A public or private institution of postsecondary education shall not allow a student to compete in an athletic competition that is designated for the biological sex opposite to the student's biological sex. This provision includes athletics competitions of intercollegiate associations.

A school district, charter school, or public or private institution of postsecondary education may allow a female student to compete in an athletic competition designated for male students if no corresponding competition for female students is offered or available.

A school district or charter school that violates the provisions of this act shall have its state aid distributions withheld as described in the act.

An institution of postsecondary education that violates the provisions of this act shall be fined as specified in the act. Additionally, any person who suffers harm arising from a violation of the act by an institution of postsecondary education shall have a private cause of action against such institution as described in the act.

This act is similar to SS#2/SB 39 (2023), HB 337 (2023), and HB 2197 (2022).
